It has come to the attention of the Trustees that there are a number of homeowners that have storage sheds located on their property. We have conferred with legal counsel regarding this and have determined that such sheds are in violation of the Declaration of Restrictions of Claymont Subdivision. Specifically, the Declaration provides that “[n]o building shall be erected, altered, placed or permitted to remain on any lot other than one detached single-family dwelling.” (Declaration, Paragraph 2). A storage shed would constitute a “building” within the meaning of this provision and is not permitted.
In addition, Paragraph 3 of the Declaration provides that “No building shall be erected, placed or altered on any lot until the construction plans and specifications and a plan showing the location of the structure on the lot have been approved by the Architectural Control Committee…” Under this provision, any such shed would require approval by the Trustees, acting as the Architectural Control Committee. However, the Trustees recognize that there are a number of storage sheds in the subdivision and that it would work a hardship on numerous residents to require the removal of these sheds. Given this, the Trustees have instead decided to request that any homeowner with a shed on his or her property enter into an agreement with the Association to remove the shed when he or she sells or otherwise conveys the house to another party. If you have a storage shed located on your property, please contact the undersigned as soon as possible and make arrangements to enter into such an agreement.
